Welcome to MICO (the "Platform")! The MICO Terms and Conditions (the "Terms") are a binding contract between the user accessing or using the Platform ("You") and Mico World Limited ("Mico", "MICO" or "We"). These Terms cover your rights and the rules that apply to your use of the Platform and our related websites, services, applications, products and contents (collectively, the "Services"). The Services are provided to you worldwide by us and our affiliates.
Our Services are intended for adults only, and you must be at least 18 years of age (or the age of majority under local law) to use our Services. If you are under the age of 18 (or the age of majority under local law) and still use our services, we have the right to block your account and delete all the data under the account after discovery, and your guardian should take full responsibility for your behavior. If you find that the minor under your guardianship is using MICO, please contact us in time and we will assist you in deleting the relevant account.
You may use our Services by visiting our official website or downloading and installing our applications from our authorized application marketplaces (such as Apple App Store and Google Play, you may check our official website for detail). If you have not obtained our products or services from the aforementioned sources, we cannot guarantee the authenticity of versions obtained from unofficial sources or the proper functioning of such versions. We are not responsible for any compensation or reimbursement arising from the use of unofficial versions of our applications.
If any provisions of our Terms potentially become invalid due to conflict with relevant laws and regulations, these provisions shall be re-interpreted and reapplied in accordance with the principle of being as close as possible to the purpose of these Terms without violating the law. Invalidity of some provisions will not affect the complete validity and effect of the other provisions in these Terms.
You understand and accept that, due to reasons including but not limited to force majeure and security reasons, MICO does not provide services such as APP online, payment, and payroll pickup in Iran, North Korea, Sudan, Syria, Cuba, Myanmar, Yemen, Iraq, and Somalia, etc., for a period of time to be assessed by a combination of MICO and other necessary organizations.
MICO is a live streaming app that provides tons of International live streams for users. Here we provide you with high-quality international live stream and live videos from many parts around the world, such as the US, Thailand, Malaysia, and so on. At MICO, you can enjoy live chat with friends either local or global directly in a chat room, share photos and short videos on Moments and get followers and support from all over the world.
We are committed to providing you with a positive, energetic and healthy environment in MICO, and it is important for both of us to keep it safe and friendly. Please read these Terms carefully. By completing the registration process and/or browsing/using the Services, you signify that you have carefully read and agree to the contents of these Terms, and that you agree to be bound by them. You guarantee that you have the right and ability to sign the Terms. These Terms are written in English (U.S.). If any translated version of these Terms conflicts with the English version, the English version shall prevail.
If you do not accept and agree to these Terms, you may not access or use our application or website.
We may periodically update these Terms to address Services updates, legal changes, and other factors. We will make commercially reasonable endeavours to notify all the users uniformly of any changes to these Terms that may materially and substantially affect your rights, for example through notices or pop-ups on the Platform. We also recommend you regularly review these Terms to check for any changes. We will indicate the Last Update date at the top of these Terms and your continued use of our Services after the update date signifies your agreement to the updated Terms. If you do not agree with the updated version of our Terms, you may stop using our Services.
(1) You may register for an account in our Services by your phone number or by the user account of the third-party software or platform (e.g. Apple, Google and Facebook) that you legally own. If you choose to register through third-party software or platform, you should ensure that the user account you use has completed the authentication of real identity information and meets the requirements of relevant laws and regulations. When you register for an account through the third party platforms, the third parties will provide us with the personal information that you have already provided to them for the purpose of creating an account, including your avatar picture, username, gender, age, etc. (depending on your settings in the third party platforms).
(2) Your account is for your personal use only, and you are prohibited from giving, borrowing, renting, transferring, selling or otherwise licensing the account to others without our writing permission. If we have reasonable grounds to believe that the actual user is not the account registrant, we have the right to suspend or terminate the provision of Services to this account in order to protect the security of the account. You are solely responsible for all actions taken under your account.
(3) You should provide true, accurate, legal and valid identification materials and necessary information when you register and use your account. You may not provide any false personal information on MICO or create an account for anyone other than yourself without permission. If the information you submit is inaccurate, untrue, illegal or we can reasonably believe that the above information is doubtful, we have the right to request you to correct or supplement it, or refuse to provide you with the relevant services.
(4) You shall maintain the security and confidentiality of your account and your password. You should not share your password with any other user or any third party, or you will be at risk of account theft. If you lose your account or forget your password, please contact us promptly and we will freeze your account or assist you to find back your password, and take reasonable efforts to protect your rights. We are not responsible for loss of accounts not caused by us.
(5) You can request to delete your account. In order to protect your account security and property rights, before you request to delete your account, you should ensure that the account is in a normal state, otherwise, you may not be able to delete it. A "normal status account" means that:
a.The account is registered by you through our official channels and used by yourself;
b.There are no unpaid orders in the account;
c.There are no unprocessed complaints, disputes or controversies in the account, including but not limited to those that have not been unfrozen or restored after being frozen, and those that have complained about or been complained about by others; and
d.There are no other circumstances that prevent account deletion.
We will complete the deletion 14 days after you confirm your request to delete your account. You can withdraw your request for account deletion at any time within 14 days of submitting your request. Logging in again means that the deletion request has been withdrawn.
If your account is successfully deleted, it means that your account and all data under your account will be completely deleted, and you will no longer be able to use this account to log in and use the corresponding services, and you will no longer be able to access any content under your account (including friend information, posts, videos, etc.), and paid subscriptions or property rights not yet utilized will be deemed to have been abandoned by you and can no longer be used. Once account deletion is complete, it will not be possible to recover, so please consider carefully before deleting.
Your access to and use of the Services is subject to these Terms and all applicable laws and regulations.
Sharing content and information
The various types of content you create, publish, and share on MICO, including photos, messages, and other materials ('Content'), must not contain the following elements:
(1) contains profanity or language that may be considered offensive or that may harass, embarrass, alarm, or annoy any other person;
(2) is obscene, pornographic, or otherwise likely to violate the dignity of another person;
(3) abuses, insults, slanders, or threatens another person or promotes or encourages violence or discrimination on the basis of race, gender, religion, nationality, disability sexual orientation or age;
(4) encourages any unlawful activity, including but not limited to, terrorism, incitement to racial hatred, hateful content, or conduct that constitutes a criminal offence in itself;
(5) in connection with commercial activities (including, but not limited to, sales, contests and advertisements, and linking to other web sites or high end phone numbers);
(6) contains dissemination of "spamming";
(7) contains any spyware, viruses, worms or other malicious code, or content designed to interrupt, damage, limit or interfere with the functionality of any software, hardware, telecommunications, networks, servers or other equipment;
(8) violates the rights of any third party (including but not limited to, intellectual property rights and the right to privacy);
(9) contains narcotics or drug use;
(10) contains politically relevant content;
(11) uses the Services in a manner that may create a conflict of interest or undermine the purpose of the Services, such as writing or soliciting false reviews;
(12) contains personal information about minors or any other form of information;
(13) violates these Terms, the provisions of relevant laws and regulations, and that MICO has reasonable grounds to believe is inappropriate.
We respect the rights of users and do our best to keep MICO safe and clear. You therefore agree not to engage in the conducts described below (or to facilitate or support others in doing so):
(1)Illegal intrusion into the network, interference with the normal function of the network, theft of network data and other activities that endanger the security of the network, to help others to carry out such acts or provide special tools;
(2)Reverse engineering of our Products, taking any action that may lead to the discovery of source code or circumvent measures to prevent or restrict access to any part of our Services;
(3)Attempt to circumvent any content filtering techniques employed by us or attempt to access any feature or area of our Services that you are not authorized to access;
(4)Attempt to interfere with or disrupt the normal operation of the system or website, intentionally spreading malicious programs or viruses and other acts of sabotage that interfere with normal network information services;
(5)Maliciously register accounts, including but not limited to frequent and batch registration of accounts;
(6)Engage in any harassment, threat, intimidation, predatory or stalking behaviour; and
(7)Use our Services for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms;
(8)Any behavior that violates laws and regulations or infringes on our legitimate rights and interests or those of a third party.
If we discover that you have posted any of the above offending Contents or have committed any of the above violations, we reserve the right to investigate such violations and to impose penalties, including but not limited to, deletion of the offending Contents, temporary or permanent suspension of your account, and prohibition of your re-registration. If your conducts constitute a criminal offense, you agree that we reserve the right to refer the matter and your violation to, and cooperate with, any and all applicable legal authorities. You shall be solely responsible for your conduct.
(1) You understand and agree that we have the right to formulate management rules for anchors and manage and supervise your live broadcasting behaviour, and have the right to make adjustments or changes to the corresponding rules in accordance with the laws and regulations, regulatory policies and changes in the industry norms and the needs of service operation, without the need to obtain additional consent of the anchors.
(2) You understand and declare that becoming a contracted anchor does not mean that there is any legal employment, labour or service relationship with MICO, and we do not need to bear any social insurance and welfare to you.
(3) You shall bear the expenses and equipment related to carrying out the webcast. You shall protect your physical and property safety during the live webcast. You yourself should be fully responsible for all activities carried out under the live account. If you lead any damage to yourself or any third party in the process of webcasting, you should be responsible for your own; if we suffer losses as a result, you should compensate us.
(4) You are prohibited from performing the following acts:
a. Use false identity information to create a MICO Live account;
b. Use another person's bank payment information to withdraw live rewards;
c.Giving, transferring, lending, renting, selling or guaranteeing the live account to a third party;
d.Engaging in live broadcasting activities other than those agreed upon in these Terms or other business purposes added by MICO in accordance with the development needs of the platform (including but not limited to, advertising, promotion, inter-mediation, and agency services without our permission; or providing value-added services to a third party based on live broadcasting activities);
e.Engaging in money laundering, bribery, terrorist financing or other illegal or criminal activities.
f. Posting any content or conducting behavior in the live activities that violates these Terms, applicable laws and regulations.
In addition to the foregoing, your access to and use of the Services must at all times comply with thses Terms and any other agreements you enter into with us (includingMICO Platform Guidelines ).
If we have reasonable grounds to believe that your behaviour violates or may violate our Terms, Guidelines and relevant laws and regulations, we have the right, at our sole discretion, to take restrictive measures on your account, including terminating the provision of all or part of the Services to you, deleting the relevant content posted by you, temporarily banning or permanent banning of your account, blocking the IP address, etc., and pursuing the related parties for their legal liabilities in accordance with the law. We are not required to give you prior notice or return any unused services to you.
(1)MICO pays close attention to the interests, feedback, comments and suggestions of our users. If you choose to send us any ideas about products, services, features, modifications, enhancements, content, improvements, technologies, content offerings or other materials (collectively, "Feedback"), you acknowledge and agree that:
a.We are under no obligation to review, consider, or act upon your Feedback, or to return any Feedback to you, in whole or in part, for any reason whatsoever, and will not compensate you for your Feedback;
b.The Feedback you provide is non-confidential and we are under no obligation whatsoever to maintain the confidentiality of any Feedback you send or to refrain from using or disclosing the Feedback in any way.
(2)In order to maintain the safety of the MICO community, we have provided you with a channel for reporting and filing complaints. You can click "Complain" on the user's profile page, select the reason for the complaint, and complain about the user directly from the profile page. You can also report any violation of laws and regulations or our Terms and provide relevant proof. Your complaints will be verified by our team, and we will formulate appropriate procedures according to the actual situation, and get back to you within a reasonable period of time. If you think we have handled it incorrectly, you can file a complaint via contact@micous.com. We will do our best to help solve any problems you may encounter when using our services.
You promise that, according to the laws and regulations of your location, you have complete legal capacity to make independent purchases.
(1) MICO allows users to purchase virtual coins ("MICO Coins") to be used for rewarding in MICO Live Streams or purchasing gifts for your friends. MICO Coins can be purchased through third-party payment service provider (e.g., Apple Store or Google Play, etc.), we do not directly process any payment. Please note that you are subject to the terms and conditions of the third-party payment service provider.
(2) You acknowledge and agree that you shall be responsible for the use of the MICO Coins in your account, and that Coins are not allowed to be traded, exchanged for cash, legal tender of any country, region or any political entity or any other form of credit, or used for any form of investment.
(3) The exchange price of MICO Coins, the categories and prices of virtual gifts may be affected by our considerations about business operations, legal tender exchange rates and other factors, and we reserve the right to make adjustments at any time. The specific prices are subject to the actual results displayed on the relevant pages within the product. We do not assume any responsibility for any problems (e.g. price difference, change of gift categories, etc.) caused by the above adjustments.
(4) The use of the MICO Coins purchased by you is limited to lawful purposes within the scope of the Services and must always comply with all applicable laws. You may not use MICO coins for any activity, product, action or service that is considered unauthorized under these Terms.
(5) If your account is terminated by MICO for any violation of these Terms or applicable laws and regulations, any unused Coins remaining in your account at the time of termination may be forfeited, and we will not be liable for such forfeiture.
(6) You understand that MICO may revise or update the rules of sale and use relating to MICO Coins and that the terms of such revisions will apply to all subsequent purchases of Coins. We recommend that you review our Terms and any rules relating to the sale of MICO Coins before making any purchase.
(7) If a bill of MICO Coins has been successfully purchased and credited to your account and the transaction complies with applicable law, we do not support user refunds unless otherwise provided by law or regulation.
(8) If you spend MICO Coins to purchase our subscription services, you will not be able to cancel your purchased subscription services from the time the subscription becomes effective, and MICO Coins already consumed will not be refunded.
(1) MICO does not claim any ownership rights in the text, files, photographs, videos, sounds, musical compositions, works of authorship, applications, or any other materials that you post on or through the Services (collectively, "Contents"). By displaying or publishing any Contents on or through our Services, You hereby grant to MICO an unconditional, irrevocable, non-exclusive, transferable, royalty-free, perpetual worldwide license to use, modify, delete, add to, publicly perform, publicly display, perpetuate, reproduce and translate such Contents. For example, we may distribute some or all of the Contents (except the Contents you have not publicly posted) in any media formats through any media outlets (including Google, YouTube, Facebook, Instagram, etc.). You acknowledge and agree that we may generate revenue, increase goodwill, or otherwise add value to us from the Contents you upload and your use of the Services, and that you are not entitled to a share of any such revenue, goodwill, or value unless we agree otherwise with you.
(2) You represent and warrant that: (i) you have all necessary rights or licences in respect of the Contents that you post on or create through the Services. You understand and agree that all your Contents are considered non-confidential and non-proprietary and that you may not post any confidential or proprietary Contents on the Services. By creating, uploading, and posting Contents through the Services, you agree that the said Contents may be transmitted to any third party; (ii) your posting and use of the Contents on or through the Services does not violate privacy, public interest, copyright, contractual rights, the intellectual property rights of any person or any other rights, and (iii) posting of your Contents will not result in a breach of contract between you and any third parties.
(3) Our content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music, and all intellectual property rights relating thereto (collectively, the “MICO Contents” ) are owned by or licensed to MICO, and are protected by copyright, trademark, trade secret and other intellectual property laws. We own and reserve all rights to the MICO Contents and our Services. We hereby grant you a limited, revocable, non-transferable, non-sub-licensable, limited license to reproduce and display the MICO Contents (but not include any software code, classified information, and other users' private information) solely for your personal use in connection with your visit to our website and use of our Services.
(4) In order for you to use the Services properly, you should comply with these Terms and other regulations relating to intellectual property:
a.Except as expressly permitted by us or our licensors, you cannot sell, resell, commercially use, copy, modify, reproduce, derivative use, distribute, publicly perform or publicly display MICO Contents, or remove any proprietary rights notices or markings from our Services.
b.Unless you have an explicit permission from MICO in written form, you are not allowed to use any data mining, robots or similar data gathering or extraction methods to extract the source code, decompile or create other products related to the Services or its software.
Your privacy is important to us. Our Privacy Policy is designed to provide important disclosures about how you use MICO to share with others and how we collect and use your content and personal information. We suggest you to read our Privacy Policy for details.
To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, punitive, incidental, special or exemplary damages, including but not limited to damages for loss of profits arising out of your use of the Services - whether based in contract, tort, negligence, strict liability, warranty, or otherwise. Except as otherwise expressly provided by law or regulations, our entire liability to you, regardless of cause or course of conduct, shall at all times be limited to the amount of fees, if any, within the past 12 MONTHS paid by you to us in connection with your use of the Services.
(1)While we make every effort to ensure the continuity and security of the Services, our Products and Services may be affected or interfered with by a variety of factors. You understand and agree that we are exempted from liability to the extent permitted by laws and regulations for any suspension, discontinuance, termination of the Services or any damages caused by the following circumstances:
a.Due to force majeure and other factors, including but not limited to governmental actions, natural disasters (such as floods, earthquakes, typhoons, etc.), war, strikes, riots, epidemics and so on;;
b.Because of factors beyond our control such as power failure, communication network failure, hacker attacks, malicious program attacks, viruses, third-party service defects, and so on; and
c.Inability to access the Service due to your personal reasons (e.g. equipment, network links, etc.).
(2)Your use of our Services is at your sole risk. Our Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, we do not represent or warrant that the services are accurate, complete, reliable, current or error-free.
(3)We will not be liable for any loss or damage resulting from:
a.any changes we make to the Services, or the permanent or temporary suspension of the availability of the Services or of some of the features on the Services;
b.the deletion, corruption or loss of any Contents that you upload, post or transmit through the Services;
c.you fail to provide us with accurate account information; or
d.the inaccuracy of any content (including users’ Contents) obtained through the Services.
(4)If you violate the Terms in the course of using the Services provided by us or engage in any misconduct (such as violation, misappropriation or infringement of any rights of another, including intellectual property rights or privacy rights) through the account we provided, you shall promptly notify us of any third-party claims, cooperate with us in the defense of such claims, and pay the related fees, costs, and expenses to the fullest extent permitted by law (including but not limited to, attorneys’ fees), and you shall agree to allow us to determine the defense or settlement of any third-party claim.
(5)Access to third party services within the Services provided by us does not imply that we have conducted a rigorous review, and we do not provide any warranty with respect to such third party services. Third-party websites are not under our control. If you choose to access them, please read and accept the terms of use of the third-party websites in advance and assume all risks associated with them.
(6)Our Services are provided for private scenarios only. You agree not to use our Platform for any commercial or business purposes and we shall not be liable to you for any commercial and business losses.
You may terminate our Terms with us at any time and for any reason, provided that you delete your account. Should you terminate the Terms, all of your data will be deleted and is not able to be recovered, unless MICO stores any information in accordance with our Privacy Policy and the applicable laws.
We may terminate your access to or use of the Services for any reason in our sole discretion, including if we reasonably believe that you have violated our Terms without notice, or you have created a legal risk for us. We are not responsible for any loss or injury resulting from your inability to access or use the Services.
You agree to defend, indemnify, and hold harmless MICO and its parents, subsidiaries, affiliates, and their respective officers, directors, employees, agents, and advisors from and against any and all claims, liabilities, costs, and expenses arising from breach of these Terms or any breach of the obligations, representations, and warranties set forth herein by you or any other who uses your account, including, but not limited to, attorneys' fees and expenses.
If we have any dispute with you relating to or arising from these Terms, we will first attempt to resolve it amicably with you. You agree to do the same for us.
In the event that we do not agree on such dispute, the parties agree that these Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to the rules of conflict law. Any dispute arising out of or in connection with these Terms, including any question relating to the existence, validity, interpretation or termination of these Terms, shall be submitted to and finally resolved by arbitration at the Hong Kong International Arbitration Center ("HKIAC") in accordance with the HKIAC Arbitration Rules then in force. The place of arbitration shall be Hong Kong. The language of the arbitration shall be English.
You understand and agree that you must initiate arbitration or litigation within one year from the date of the occurrence of the facts that arise a dispute arising out of or relating to these Terms. Otherwise, you forever waive your right to bring any claim of any kind or nature based on such facts, and such claim will be permanently barred.
